Privacy Policy

1. Introduction and Scope.

R2 Technologies, Inc., and its subsidiaries and affiliates (collectively, “R2,” “we,” “us,” and “our”) value and want to protect your privacy. We recognize privacy is important to you and any of our users, customers, and providers (collectively, “you” or “Users”). This Privacy Policy (“Privacy Policy”) informs you of our policies and procedures for the collection, use, and disclosure of information through www.Glacialskin.com (“Site”). This Privacy Policy includes our products (e.g., our Glacial Rx System), and our other websites, features, mobile or desktop applications, and/or online services owned or controlled by R2 (collectively with the Site, “Services”).

This Privacy Policy is subject to and incorporates by reference R2’s Terms and Conditions Agreement. This Privacy Policy also includes any information we collect and retain offline in connection with our Services (e.g., we combine the information we collect from you from the Site, through the Services generally, or offline). This Privacy Policy applies when you access and use our Services. We offer our Users the choice about the information we collect, use, disclose, and share, as described in this Privacy Policy. This Privacy Policy also informs you about your rights to access, control, revise, and delete your information.

We reserve the right in our sole discretion to make changes to how we operate and provide our Services, including adding new services, modifying existing services, or suspending, discontinuing, or terminating your access to any or all portions of our Services, as described below in this Privacy Policy. This Privacy Policy applies to all information we may gather about you when you use and/or interact with our Services, including but not limited to any electronic communications and user submissions as necessary for us to comply with applicable laws and provide a satisfactory experience for our Users (collectively, “Personal Information”).

This Privacy Policy describes the choices available to you regarding the use of your Personal Information and how to access, update, or correct your Personal Information. To that end, we are not responsible for the privacy practices of any third parties, as that information is beyond our reach, and you should not contact us for any rights, claims, or concerns regarding privacy policies of any given third party. This Privacy Policy does not apply to the practices of companies that we do not own or control, or to any individuals that are not under our supervisory control directly or indirectly.

Information We Collect.

If you choose to use our Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. We will not use or share your information with anyone except as described in this Privacy Policy.

We collect information about you directly from you when you register on our Site and/or use our Services; fill out forms or fields such as when you request to be registered as a service provider or a registered User (e.g., a User registered for R2’s loyalty programs) and use our Site and Services (including its “Contact Us” forms); through any Services you opt in to (e.g., when you use our subscription services, loyalty programs, marketing and social media initiatives, and any other similar services); and your communications with us.

R2 may provide future Services and/or products in which we may potentially seek to collect health-related information about you (or your company) to improve and customize those future Services and/or products. Such information may include, but is not limited to, conditions, medications, prescription data, and/or anticipated medical treatments; Personal Information that we may collect if you report a possible side effect associated with one of our Services; your responses to surveys; and your search queries.

Information You Provide. The types of Personal Information we collect depends on the products and portions of our Services you use. The Personal Information includes: your first and last name, physical address, phone number, email address, location (e.g., zip code, city, and state), preferred treatment day and time, age, gender, date of birth, documents, or other demographic information and media that verifies your identity (or company’s identity). If you are a health care practice or service provider, information about your practice or service provider such as specialty.

Information Collected Automatically. We collect information about your computer, mobile phone, or other access device and anonymous information about your web request, Internet Protocol (“IP”) address, geolocation data, browser type, referring exit pages and URLs, number of clicks and how you interact with links on the Site, domain names, landing pages, pages viewed, your use of third-party applications, and other information that assists us in analyzing and improving the Services.

Sensitive Personal Information. R2 collects sensitive personal information, including health-related and skin condition data, through consultations and device use (e.g., use of the Glacial Rx System). We collect this information to provide and improve our Services and to customize your experience. Sensitive personal information is handled with additional safeguards and is not sold or shared for advertising purposes. California residents have the right to limit our use of sensitive personal information as described in Section 13 of this Privacy Policy.

General Audience Services.

Our Services are general audience and intended for users 18 and older. We do not knowingly collect Personal Information from anyone younger than age 18. If we become aware that a child younger than 18 has provided us with Personal Information, we will use commercially reasonable efforts to delete such information from our files. If you are the parent or legal guardian of a child younger than age 18 and believe that we have collected Personal Information from your child, please contact us at: info@glacialskin.com.

In the case we discover that a person under 18 has provided us with Personal Information, we immediately delete this from our servers. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us so that we will be able to take the necessary actions.

Information Collected Through Cookies and Similar Technologies.

We receive information through cookies and similar technologies. We may collect information from and about the devices you use, including hardware model, operating system version, device memory, unique application identifiers, apps installed, unique device identifiers, browser type, and information about your wireless and mobile network connections, such as mobile phone number, service provider, IP address, and signal strength.

When you visit or leave our Services (including some plugins and our cookies or similar technology on the sites of others), we receive the URL of both the site you came from and the one you go to and the time of your visit. We also get information about your network and device (e.g., IP address, proxy server, operating system, web browser and add-ons, device identifier and features, cookie IDs and/or ISP, or your mobile carrier). If you use our Services from a mobile device, that device will send us information about your location based on your phone settings. We will ask you to opt in before we use GPS or other tools to identify your precise location.

We use cookies (small text files sent by your computer each time you visit our Site, unique to your account, User Profile, or browser) to get log data. We may use cookies and similar technologies (e.g., pixels and ad tags) to collect data (e.g., device IDs) to recognize you and your device(s) on, off, and across different services and devices where you have engaged with our Services. For example, we may use cookie-related technologies, such as Meta pixels and Google Tag Manager, to identify and track consumer behavior generated from our paid social media and advertisements.

If you are outside the Designated Countries, we also collect (or rely on others who collect) information about your device where you have not engaged with our Services (e.g., ad ID, IP address, operating system, and browser information), so we can provide our Users with relevant ads and better understand their effectiveness. You can opt out from our use of information from cookies and similar technologies that track your behavior on the sites of others for ad targeting and other ad-related purposes.

Links to Other Sites.

Our Services may contain links to other websites or online services operated by third parties. If you click on a third-party link, you will be directed to that third party’s website or service. These external sites are not operated by R2, and we do not own or control them. We strongly advise you to review the privacy policy of any third-party website you visit, as this Privacy Policy does not apply to those third-party websites or services.

Your browsing and interaction on any third-party website or service, including those that have a link or advertisement on the Site, are subject to that third party’s own rules and policies, including their terms and conditions and privacy practices. R2 is not responsible for the privacy practices, content, or security of any third-party websites or services, and any information you provide to such third parties is beyond our control.

If you are using a third-party website or service and you allow such a third party access to your Personal Information, you do so at your own risk. You should not contact R2 for any rights, claims, or concerns regarding the privacy policies of any third party.

How We Use Your Information.

We will never use or share the Personal Information provided to us by you in any way that violates or is otherwise unrelated to the means described in this Privacy Policy, without also providing you an opportunity to opt out or otherwise prohibit such unrelated uses. We use the information you provide for the following purposes:

Pairing Users with practices or service providers in the User’s area that have or use our Services.

Sending Users marketing communications about our Services (e.g., our Glacial Rx Promotions) and information about service providers in those Users’ areas.

Providing, maintaining, and improving our Services, products, and treatments, including through our affiliates.

Communicating updates, promotions, or news about R2, our Services, products, treatments, or events through email, direct mail, text messages, push notifications, or other channels.

Protecting R2, our Users, and our Services.

Preparing government reports and communicating administrative or legislative information.

Responding to your requests and inquiries.

Enabling communications between Users, including invitations, newsletters, groups, and messages between connections.

Generating de-identified or aggregated statistics that do not identify you, such as statistics about our Users, their professions or industries, ad impressions, or visitor demographics.

You may change your communication preferences at any time. You cannot opt out of receiving service messages from us, including security and legal notices. For information about opting out of marketing communications, see the Opt-Out Policy in Section 8.3 of this Privacy Policy.

How We Disclose and Share Your Information.

You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from us at all times. We cannot ensure or warrant the security of any information you transmit to us or guarantee that information may not be accessed, disclosed, altered, or destroyed. If any information under our control is compromised because of a breach of security, we will take reasonable steps to investigate the situation and, where appropriate, notify those individuals whose information may have been compromised and take other steps in accordance with any applicable laws and regulations.

Service Providers. We use others to help us provide our Services (e.g., maintenance, analysis, audit, payments, fraud detection, marketing, and development). They will have access to your Personal Information as reasonably necessary to perform these tasks on our behalf and are obligated not to disclose or use it for other purposes.

Legal Disclosures. We may need to share your Personal Information when we believe it is required by law or to help protect the rights and safety of you, us, or others. We may disclose information about you when required by law, subpoena, or other legal process, or if we have a good faith belief that disclosure is reasonably necessary to:

Investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies;

Enforce our agreements with you;

Investigate and defend ourselves against any third-party claims or allegations;

Protect the security or integrity of our Services (such as by sharing with companies facing similar threats); and/or

Exercise or protect the rights and safety of R2, our Users, personnel, and/or any other entities.

We attempt to notify our Users about legal demands for their Personal Information when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague, or lack proper authority, but we do not promise to challenge every demand.

Change in Control or Sale. We may share your Personal Information when our business is sold to others, but it must continue to be used in accordance with this Privacy Policy. We can also share your Personal Information as part of a sale, merger, or change in control, or in preparation for any of these events. Any other entity which buys us, or part of our business, will have the right to continue to use your Personal Information, but only in the manner set out in this Privacy Policy unless you agree otherwise.

Your Choices and Rights.

Information Retention. We retain your Personal Information for as long as necessary to fulfill the purposes described in this Privacy Policy, subject to applicable legal requirements. Specific retention periods depend on the type of information and the purpose for which it was collected:

Account information is retained while your account is active and for 30 days after closure.

Health and skin condition data is retained as long as needed to provide the Services and to comply with applicable medical record retention requirements.

Marketing preferences and opt-out records are retained indefinitely to honor your opt-out requests.

De-identified or aggregated data may be retained indefinitely.

Rights to Access and Control Your Personal Information. You can request to delete your Personal Information by contacting us directly at info@glacialskin.com, and we will promptly consider your request in accordance with applicable laws. Residents in the Designated Countries and other regions may have additional rights under their laws.

Opt-Out Policy. Users are automatically added to receive newsletters and updates regarding R2 and its affiliates, our Site and Services, and User Profiles and Personal Information. You may opt out from receiving newsletters, promotional offers, and other types of emails and texts. To unsubscribe from our mailings (except important system and content update information), you may go to an email you received from us, scroll down to the bottom of the email, and select “unsubscribe.” Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services. If you wish to be removed from receiving future communications, you can opt out by texting STOP.

Account Closure. If you choose to close your account, your Personal Information will generally cease to be visible to others on our Services within 30 days. We generally delete closed account information within 30 days of account closure, except as noted in the retention periods above or where retention is required by law.

Security. We take reasonable measures to protect your Personal Information from unauthorized access, use, or disclosure. No method of transmission over the Internet or method of electronic storage is completely secure, however, and we cannot guarantee absolute security. If any information under our control is compromised because of a breach of security, we will take reasonable steps to investigate the situation and, where appropriate, notify those individuals whose information may have been compromised and take other steps in accordance with any applicable laws and regulations.

Lawful Bases for Processing Your Information.

We process your Personal Information on the following lawful bases, as applicable:

Consent: Where you have given us clear consent to process your Personal Information for a specific purpose, such as opting in to receive marketing communications or submitting health-related information through a consultation form.

Performance of a Contract: Where processing is necessary to perform our obligations under an agreement with you, including providing access to our Services, fulfilling transactions, and managing your account.

Legitimate Interests: Where processing is necessary for our legitimate business interests (or those of a third party), provided those interests are not overridden by your rights. Our legitimate interests include operating and improving our Services, ensuring network and information security, preventing fraud, and communicating with you about our products and Services.

Compliance with Legal Obligations: Where processing is necessary to comply with applicable laws, regulations, court orders, or other legal requirements to which R2 is subject.

Where we rely on your consent as the lawful basis for processing, you have the right to withdraw that consent at any time by contacting us at info@glacialskin.com. Withdrawal of consent does not affect the lawfulness of any processing conducted prior to your withdrawal.

Changes to This Privacy Policy.

We may update this Privacy Policy from time to time to reflect changes in our practices, Services, or applicable laws. When we make changes, we will revise the “Last updated” date at the top of this Privacy Policy. If we make material changes, we will provide notice through the Services or by other means, such as email, prior to the change becoming effective.

We encourage you to review this Privacy Policy periodically to stay informed about how we collect, use, and protect your Personal Information. Your continued use of the Site or Services after any changes to this Privacy Policy constitutes your acceptance of the updated Privacy Policy.

If you do not agree with any changes, you should discontinue your use of the Services and contact us at info@glacialskin.com to request deletion of your Personal Information.

Children’s Privacy.

Our Services are not directed to individuals under the age of 18. We do not knowingly collect Personal Information from anyone younger than 18 years of age. If we become aware that a person under 18 has provided us with Personal Information, we will promptly delete such information from our servers and files using commercially reasonable efforts.

If you are a parent or legal guardian and you believe that your child under the age of 18 has provided us with Personal Information, please contact us immediately at info@glacialskin.com so that we can take appropriate action to remove that information.

SMS/Text Messaging.

If you opt in to receive SMS or text messages from Glacial Skin, your information will be handled in accordance with this Privacy Policy. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

Notice to California Residents: Your California Privacy Rights.

This section applies to California residents and supplements the rest of this Privacy Policy. It is provided pursuant to the California Consumer Privacy Act of 2018 and the California Privacy Rights Act of 2020 (collectively, the “CCPA”).

Categories of Personal Information Collected. We collect the following categories of Personal Information (with sources noted):

Identifiers: name, address, email, phone number, IP address. Sources: directly from you; automatically through Services; from service providers.

Personal information under Cal. Civ. Code Section 1798.80: name, address, phone number. Sources: directly from you.

Internet or electronic network activity: browsing history, search history, interaction with our Site and Services. Sources: automatically through Services.

Geolocation data. Sources: automatically through Services.

Professional or employment-related information (for service provider users). Sources: directly from you.

Sensitive personal information: health and skin condition data collected through consultations and device use. Sources: directly from you; through Services.

How We Use Personal Information. We use Personal Information for the purposes described in Section 6 of this Privacy Policy. We do not sell Personal Information and do not share Personal Information for cross-context behavioral advertising as those terms are defined under the CCPA.

Right to Know. You may request that we disclose the categories and specific pieces of Personal Information we have collected about you, the categories of sources, the business purpose for collecting it, and the categories of third parties with whom we share it.

Right to Delete. You may request deletion of Personal Information we have collected from you, subject to exceptions such as completing a transaction, detecting security incidents, complying with legal obligations, or exercising free speech rights.

Right to Correct. You may request correction of inaccurate Personal Information we maintain about you.

Right to Opt-Out of Sale or Sharing. R2 does not sell your Personal Information and does not share your Personal Information for cross-context behavioral advertising. No opt-out request is necessary. If our practices change, we will update this Privacy Policy and provide an opt-out mechanism.

Right to Limit Use of Sensitive Personal Information. You may limit our use of your sensitive Personal Information (such as health and skin condition data) to purposes necessary to provide the Services. We use sensitive Personal Information only to provide and improve the Services you have requested and for the purposes disclosed at the time of collection. Non-Discrimination. We will not discriminate against you for exercising your CCPA rights. We will not deny you Services, charge you different prices, provide a different level of service, or suggest you will receive a different level of service for exercising your rights.

How to Submit a Request. You or your authorized agent may submit a request by emailing info@glacialskin.com. Include your name, email address, and the nature of your request.

Verification. We will verify your identity before fulfilling your request. We may ask you to provide information that matches information we have on file. If we cannot verify your identity, we may deny your request.

Authorized Agents. You may designate an authorized agent to submit a request on your behalf. The agent must provide proof of authorization (e.g., a signed written authorization or power of attorney). We may still require you to verify your identity directly.

Response Timing. We will respond to verifiable consumer requests within 45 days of receipt. If we need additional time (up to 45 more days), we will notify you in writing.

California “Shine the Light.” Under Cal. Civ. Code Section 1798.83, California residents may request information about our disclosure of Personal Information to third parties for their direct marketing purposes. As stated in this Privacy Policy, we do not share Personal Information with third parties for their direct marketing purposes.

Privacy Rights for Residents of Other U.S. States.

Several U.S. states have enacted consumer privacy laws that provide residents with rights regarding their personal information. If you are a resident of Virginia, Colorado, Connecticut, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, or another state with an applicable consumer privacy law, you may have some or all of the following rights depending on your state:

How to Exercise Your Rights. Submit a request by using this online form. Include your name, email address, state of residence, and the nature of your request. We will respond within the timeframe required by your state’s applicable law.

Appeals. If we decline your request, you may appeal our decision by contacting us at info@glacialskin.com with the subject line “Privacy Rights Appeal.” We will respond to your appeal within the timeframe required by applicable law. If your appeal is denied, you may contact your state’s attorney general to file a complaint.
